Welcome to zip-zap! These terms and conditions (“Agreement”) govern your use of the zip-zap website (“Website”), the “zip-zap” mobile application (“Mobile Application”), and any related services (collectively, “Services”). By accessing or using our Services, you agree to be bound by this Agreement.
1. Introduction
This Agreement is a legally binding contract between you (“User”, “you”, or “your”) and xyndata s.r.o. (“xyndata”, “we”, “us”, or “our”). If you use the Services on behalf of a business, you confirm you have the authority to bind the business to these terms.
2. Accounts and Membership
- Account Responsibility: You are responsible for maintaining your account’s security and all activities occurring under your account. Notify us immediately of unauthorized use.
- Termination: We reserve the right to suspend, disable, or delete accounts that violate this Agreement or harm our reputation. Users whose accounts are deleted for violations may not re-register.
3. AI Usage and Compliance
- Use of AI Technologies: Our Services integrate AI technologies, including OpenAI and Claude.ai, to enhance functionality. While we strive for accuracy, AI-based features may contain errors or limitations. Users are responsible for verifying the accuracy of results generated by AI.
- Transparency and Rights: Users have the right to inquire about AI-driven decisions. AI tools are used to process user inputs solely to provide services, in compliance with the EU AI Act.
- Age Restrictions: Users must be at least 13 years old. Users under 18 must have parental or guardian consent to access our Services.
4. Data Processing and Privacy
- Data Collection: We collect and store user data for invoicing and communication. For more details, see our Privacy Policy.
- GDPR Rights: Users have the right to access, correct, or delete their data under GDPR. Requests can be submitted via:

5. Trial, Billing, and Cancellation
- Trial Period: We offer an 8-day trial for Services. Subscriptions automatically convert to paid plans unless canceled before the trial ends.
- Cancellation Policy: Subscriptions may be canceled at any time. However, no refunds are provided unless required by applicable laws.
- Payment Terms: Users must ensure timely payments. Failure to pay may result in suspension or termination of the account.
6. Global Service and Jurisdiction
- Worldwide Availability: Our Services are available globally. However, this Agreement is governed by Czech law, without regard to conflict-of-law provisions.
- Dispute Resolution: Disputes are subject to the jurisdiction of Czech courts. Cross-border disputes may be resolved through EU Online Dispute Resolution mechanisms where applicable.
7. Prohibited Uses
You agree not to use the Services for any unlawful purposes, including but not limited to:
- Violating applicable laws.
- Engaging in fraudulent activities.
- Harassing, defaming, or harming others.
- Uploading malicious code or interfering with Services.
We reserve the right to terminate accounts violating these terms.
8. Intellectual Property
All intellectual property rights, trademarks, and copyrights in the Services belong to xyndata s.r.o. or its licensors. You may not reproduce or distribute any intellectual property without explicit permission.
9. Limitation of Liability
- General Liability: To the fullest extent permitted by law, xyndata’s liability is limited to direct damages up to the greater of €1,000 or the total fees paid by you in the last three months preceding the claim.
- AI-Related Liability: We are not liable for indirect damages caused by AI outputs, provided they arise from unforeseeable or unintentional errors.
10. Updates to Terms
We reserve the right to modify this Agreement at any time. Updates will be published on our website, and continued use of the Services after updates signifies acceptance.
11. Severability
If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
